Men are in women’s prisons in Australia

Australian prisons are managed at a state level. Each state decides whether to keep records of inmate sex or gender, and often transgender prisoners are housed on a case-by-case basis.

Male prisoners do not need to have undergone surgery to be eligible for transfer to a female prison. Some men claim to be women so they can go to a women’s prison.

A prisoner’s location is considered ‘private information’ and the public do not have the right to know the location of individual males.

Victoria

Freedom of Information requests have confirmed that Victoria do not keep records of transgender prisoners.

Lisa Jones, Attempted Sexual Assault, VIC

It has been confirmed that Lisa Jones, a man who attempted to rape a woman in broad daylight and who has previous convictions overseas for pedophilia, is being housed in the Dame Phyllis Frost Women’s Prison in Victoria. (August 2022)

Queensland

Fair Go For Women Queensland requested information about prisoner under Right To Information legislation. They say:

Males who identify as transgender were housed in Qld prison facilities at far higher rates from 2013-3019 than females who id as transgender.

Tracking Transgender Crime

Systematic tracking the crimes of transgender males has not started yet in Australia. There are PLENTY of examples internationally. Many of these male offenders will end up in women-only prisons.

“I can’t ignore the fact that as a transgender person with male genitalia if you went to a male jail, your safety would be at risk,” Brisbane District Court Judge Paul Smith said at sentencing. “There is no guarantee if you were sent to a female jail. In fact, it may be the reverse.”
